Intouch Holding Public Company Limited (SET: INTUCH), together with Thaicom Pcl. (SET: THCOM) announced that on 6 October, they have received an Arbitration Award dated 29 September 2022, indicating that the Tribunal Arbitrators unanimously ruled that THAICOM 7 and THAICOM 8 Satellites are not Satellites under the Operation Agreement on Domestic Communication Satellite, but they are operating under License of the National Broadcasting and Telecommunication Commission.
Accordingly both INTUCH and THAICOM are not obligated to comply with the Ministry of Digital Economy and Society claim or request under the dispute.
On 25 October 2017, INTUCH and THAICOM filed a dispute with Thai Arbitration Institution, Ministry of Justice, to consider whether THAICOM 7 and THAICOM 8 Satellites were Satellites under the Operation Agreement on Domestic Communication Satellite dated 11 September 1991. The dispute was filed after the Ministry of Digital Economy and Society stated that THAICOM 7 and THAICOM 8 Satellites were Satellites under the Operation Agreement on Domestic Communication Satellite and stated a request for the full compliance with the Agreement, such as the transfer of ownership and transfer of assets, payments of overdue revenue sharing, and property insurance, to which, after having considered, INTUCH and THCOM opined that THAICOM 7 and THAICOM 8 Satellites were not Satellites under the Agreement, as THAICOM 7 and THAICOM 8 Satellites projects fell under the scope of license scheme obtained from the National Broadcasting and Telecommunications Commission.
