Advanced Info Service Public Company Limited (SET: ADVANC) has announced that on December 20, 2023, the Central Administrative Court dismissed National Telecom Public Company Limited (NT)’s petition to revoke the arbitration award to claim 16,252 million baht on additional revenue share from roaming service from ADVANC.
The statement was made in reference of to the dispute that NT (formerly, TOT Public Company Limited) filed with the Arbitral Tribunal on September 27, 2018, claiming additional revenue share from roaming service from ADVANC based on the 7th amendment to the main concession agreement for the period from July 2013 to September 2015 amounting to a total of 16,252 million Baht, with a penalty interest rate of 1.25% per month. On February 11, 2020, the Arbitral Tribunal rendered the award in favor of the Company dismissing NT’s claims. Subsequently, NT filed a petition to revoke the arbitration award with the Central Administrative Court on May 8, 2020.
This has resulted in ADVANC not being liable for the additional revenue share for NT. However, NT is eligible to file an appeal with the Supreme Administrative Court within 30 days.
