Supreme Court Rules in Favor of ADVANC in Revenue Share Dispute Case Against NT

ADVANC has announced that on 12 July 2024, the Supreme Administrative Court dismissed NT’s appeal. Consequently, the dispute is concluded and the company is not obligated to pay the additional revenue share claimed by National Telecom Public Company Limited (NT). 

Reference is made to the dispute that National Telecom Public Company Limited (NT) (formerly, TOT Public Company Limited) filed with the Arbitral Tribunal on 27 September 2018, claiming additional revenue share from roaming service from Advanced Info Service Public Company Limited (SET: ADVANC) based on the 7th amendment to the main concession agreement for the period from July 2013 to September 2015 amounting to a total of 16,252 million Baht, with a penalty interest rate of 1.25% per month. 

On 11 February 2020, the Arbitral Tribunal rendered an award in favor of the company, dismissing NT’s claims. NT filed a petition with the Central Administrative Court to revoke the arbitration award. On 20 December 2023, the Central Administrative Court dismissed NT’s petition to revoke the arbitration award and NT has subsequently filed an appeal against the Central Administrative Court’s judgment with the Supreme Administrative Court.
